The Simple Will

The Simple Will, is based upon our Standard Will template, but doesn't allow for the full range of choices offered by our Standard Will. What it does is permit you to appoint a single executor and trustee and to make a gift of the entirety of your Estate to your spouse or other named person and, if your spouse or other named person does not survive you, to give the entirety of your Estate to those of your children that survive you and attain the age of 18 years. The gift to your children takes effect (ie. vests) upon their attaining the age of 18 years, with your trustee being responsible for your Estate (with power to provide from out of your Estate for your minor children in the interim) until that time.

 

The Standard Will

This choice gives almost total flexibility to adjust our Will template to accommodate the needs of the majority of our clients. You can: appoint joint or alternate executors and trustees; apportion your Estate amongst multiple beneficiaries; make specific gifts to named people or charities; give instructions about who is to look after your minor children; give instructions on funeral and organ donation wishes; require that your executor and trustee obtain financial advice from someone of your choice; change the age at which minor children receive their inheritance; take into account a future or pending marriage or divorce; add two further layers of residual beneficiaries; exclude the provisions that requests your Executor to instruct Perth Law to administor your Estate, and which permits your executor and trustee to charge a fee to your Estate if they practice a profession.

Enduring Power of Attorney

An Enduring Power of Attorney (EPA) gives you the ability to authorise another person or persons to act on your behalf in respect of financial matters. From transacting in real property and shares, to accessing, opening and closing bank accounts, and to taking responsibility for your bills on your behalf, the list is almost endless. It's the closest thing to having a duplicate of yourself. Whilst an EPA does not displace your own authority whilst you still have capacity, it does continue through any periods of incapacity. A well considered EPA is a recommended part of Estate planning and provides some certainty that a person you know and trust will be making financial decisions for you if for some reason you can no longer make them for yourself.

Enduring Power of Guardianship

An Enduring Power of Guardianship (EPG) grants to a named person or persons power to make health, lifestyle or treatment decisions on your behalf. Unlike an EPA, which is primarily about financial decisions, an EPG is focused on matters such as where you live, what education you receive, with whom you associate, what health treatments you should receive, or who provides that treatment. The key difference is that an EPG only comes into effect when you are incapable of making certain decisions on your behalf. This may be due to an unexpected loss of consciousness, or due to the gradual loss of capacity over time. Where you have capacity to make certain decisions but not others, the EPG will extend to cover those decisions for which you do not have capacity. It is about appointing someone you know and trust to make these decisions for you in the event you no longer can.

Executors Memorandum

Free with every Will

Wills are very legal documents and need to be concise, precise and clear. There is no room to give additional information to your Executor about certain non-binding preferences or wishes you may have, nor to give them details about your assets and liabilities. Leaving your Executor a letter about such things can assist, however, what if that letter is deemed to be an informal Will when it was never meant to be. The answer is to rather prepare an Executors Memorandum, which gives non-binding instructions and information to your Executor in order to make the executor's job that much easier. When you use our online Will service, we create an Executors Memorandum for you from your choices, which you can further complete and update over time. This is free as part of our online Will service.

Advance Health Directive

An Advance Health Directive (AHD) (more commonly referred to as a 'Living Will') is a document dealing with the types of medical treatment you would wish to access or decline in the event you are unable to decide at a later time. The AHD binds treating health care workers and takes primacy over any Enduring Power of Guardianship you may have made. Because the form is about medical treatment, we do not assist you to prepare this document, but we do make the form available for download (at the conclusion of any purchase) for you to discuss and complete with your treating practitioner should you wish to do so.

If you wish to make a Will, we recommend using our self 'Assessment' form first to see whether our online Wills are suitable for your needs. Once completed, you will be taken across to our system for the making of your Will, EPA and/or EPG. If you wish to skip the self 'Assessment', or only wish to make an EPA or EPG then simply click on the 'Start' now button. Please note that our system can take a good 30 seconds to load, so if your webpage appears unresponsive for a moment, just give it a little time. Whether you are making a Will, an EPA or EPG, or a combination of the three, it is all done on the one system. If at any time you need help, our FAQs likely has the answer, or you can submit a contact request and we'll call you back. If you need to stop midway through, don't worry, you can save and return to your work for up to 30 days. And once you are done, your documents will be emailed to you immediately. Plus we'll rectify any mistakes you may make for up to 30 days after your purchase.
