PRIVACY POLICY
Introduction
This Policy updated 16 December 2015 governs:
- Saayman Prior Pty Ltd;
- Saayman Prior Pty Ltd as trustee;
- Saayman Prior Pty Ltd as trustee for the TS & JP Trust;
- Saayman Prior Pty Ltd as trustee for the TS & JP Trust trading as Perth Law;
- Saayman Prior Pty Ltd as trustee for the TS & JP Trust trading as Saayman & Prior Barristers & Solicitors; and
- Saayman Prior Pty Ltd as trustee for the TS & JP Trust trading as willfactory.com.au (hereinafter referred to as “us” or “our”);
and is prepared pursuant to the Australian Privacy Principles derived from the Privacy Act 1988 (Cth).
This Policy explains how we collect and use information, including from our websites, email receipts, form completions, or otherwise in the usual course of business. This Policy applies to all information that we collect.
Information Collected
We collect personal information concerning clients, potential clients, marketing campaign responses, queries (on our websites, via telephone calls, emails sent to us, including such queries to our employees, contractors, agents or consultants), as well as suppliers, consultants, employees and applicants for employment.
The personal information we collect may include:
- names;
- contact details including phone numbers, postal and/or residential addresses and email addresses;
- dates of birth;
- photographs;
- any facts or opinions; and
- any other personal information provided to us.
We may also collect sensitive information, which is a subset of personal information given higher protection under the Australian Privacy Principles. Such information includes:
- information concerning racial or ethnic origin, political opinions, political association, religious belief or association, philosophical belief, membership of a profession or trade association, membership of a trade union, sexual orientation and practice, and criminal records;
- health information; and
- biometric information.
Personal information collected from you, including about third parties, will be collected and protect in accordance with this Policy. Please note that in providing us with third party personal information you are warranting to us that you have the third party’s consent to do this.
Purpose of Collection
We will collect personal information where such information is reasonably necessary for the purposes of:
- contacting and communicating with you;
- seeking feedback from you;
- testimonials;
- assessing whether we are able to act for you;
- providing legal services and/or advice;
- effective operation of our business/es;
- record keeping and analysis;
- market research, business development and marketing, including direct marketing;
- sending promotional information about third parties we consider may be of interest to you.
Cloud Computing Services
We utilise international cloud computing services for e-mail, web and data storage for storage of data, which will include personal information. Countries in which such data may be stored include (but are not limited to Australia, the United Kingdom, Japan, Singapore, Indonesia, the Netherlands and the United States.
Whilst we will take reasonable steps to ensure the protection of your personal information, we cannot guarantee that such data will be stored or protected in such countries in compliance with the Australian Privacy Principles or are subject to a binding law or scheme that offers substantially similar protection. Data stored outside of Australia will be governed by the law applicable in the relevant jurisdiction.
Disclosure of Information
We may disclose personal information:
- for the purpose of providing information, products, services or marketing to you;
- to credit reporting agencies and courts, tribunals and regulatory authorities;
- to third parties, including employees, contractors, agents or consultants, who assist us in providing information, products, services, or direct mail or digital marketing to you. This may include parties located, or that store data, outside of Australia;
- to third parties in accordance with applicable law;
- to any entity or person for the purposes of obtaining finance, business or other products, for the purposes of restructuring our business, assets or company (including a related transfer), or for the sale or purchase of (including any prior consideration of the same) any part of our business, company or assets.
We will not disclose personal information:
- to third parties for their own direct marketing to you without your separate and prior permission; and
- In contravention of the law (or our professional obligations pursuant to the Legal Profession Act 2008 (WA))
Marketing
We may contact you from time to time for the purpose of marketing any products or services (including third party products or services), including offers or discounts for such products or services. We will exercise best endeavours to ensure that you are provided with an unsubscribe or opt-out feature in any such material in order that you may choose not to receive future marketing communications from us. Should you elect to unsubscribe, please note that your personal information will not be deleted, will be retained, and that we may continue to contact you for any non-marketing purpose described above.
Websites
For statistical purposes we collect information on website activity (such as the number of users who visit our website, the date and time of visits, the number of pages viewed and location).
Information Quality, Access and Correction Processes
From time to time, we may take steps to verify personal information by collecting Information from publicly available resources, for example, telephone directories or electoral rolls to improve the integrity of the Information that we hold.
Requests for access to and correction of personal information should be made by contacting our Privacy Officer using the contact details at the end of this Policy.
Links to other websites
Websites belonging to us may contain links to other websites of interest, including third party websites. We are not responsible for or liable for the protection and privacy of any Information which you provide whilst visiting such third party websites, and such third party websites are not governed by this Policy.
Amendments
We may amend this policy from time to time in our sole discretion. We will notify you by posting an updated version of the Policy on our website.
Acceptance of the terms of our Privacy Policy
